TERMS AND CONDITIONS OF SALE, RETURNS AND WITHDRAWAL

2. Subject Matter of the Contract

These Terms and Conditions govern the online sale of products related to collectibles and gaming, including but not limited to:

  • TCG collectible cards

  • Single cards

  • Booster packs

  • Sealed boxes

  • ETBs, displays, and bundles

  • Gaming accessories

  • Sealed products

  • Collectible merchandise

3. Acceptance of the Terms

By placing an order, the customer acknowledges that they have read, understood, and fully accepted these Terms and Conditions.

4. Eligible Purchasers

The following entities may place orders:

  • Private consumers

  • Companies

  • Professionals

  • Resellers, subject to seller approval where required

A consumer is defined as a natural person acting for purposes outside their trade, business, craft, or profession.

5. Conclusion of the Contract

The contract is deemed concluded when the customer receives order confirmation by email or through the website's automated confirmation system.

The automatic acknowledgment of receipt does not constitute final acceptance in cases involving product unavailability, technical errors, or administrative checks.

The seller reserves the right to refuse, cancel, or suspend orders in the following cases:

  • incomplete or incorrect information;

  • non-payment;

  • suspected fraudulent activity;

  • pricing errors;

  • product unavailability;

  • abusive customer behavior.

In such cases, any amounts already paid will be refunded.

6. Prices

All prices are displayed in Euro (€), unless otherwise specified.

Prices may be changed at any time. The price displayed at the time of order placement shall prevail.

In the event of an obvious, abnormal, or manifestly incorrect pricing error, the seller reserves the right to cancel the order and issue a full refund.

7. Product Availability

Product availability is indicative and does not constitute an absolute guarantee of stock.

Simultaneous sales, inventory errors, or synchronization delays may result in product unavailability after an order has been placed.

In such cases, the customer may choose between:

  • full refund;

  • replacement with an equivalent product;

  • waiting for restocking;

  • store credit or another mutually agreed solution.

8. Pre-Orders

Certain products may be sold on a pre-order basis.

Release dates communicated by publishers, manufacturers, or distributors are indicative and may be subject to change.

The seller shall not be liable for official release delays, logistical delays, or reductions in allocations assigned by distributors.

In the event of lower-than-expected allocations, ONYTCG may:

  • reduce the quantities available for purchase;

  • fulfill orders in chronological order;

  • offer a full or partial refund.

9. Collectible Cards and Sealed Products

Collectible cards may present:

  • normal manufacturing tolerances;

  • minor printing defects;

  • small surface marks;

  • centering imperfections;

  • slight factory warping;

  • minor cutting or finishing variations.

Such characteristics, when consistent with industry standards, do not constitute defects.

Product images are for illustrative purposes only unless explicitly stated to be actual scans of the item.

The random contents of booster packs, boxes, and sealed products are determined solely by the manufacturer.

The seller does not guarantee pull rates, specific rarities, or predetermined contents.

Subjective grading evaluations do not constitute valid grounds for a return.

10. Payment Methods

The following payment methods are accepted:

  • PayPal

  • Credit and Debit Cards

  • Bank Transfer

  • Scalapay

  • Stripe

Orders may only be shipped after payment confirmation, except for payment systems providing immediate authorization.

11. Gift Cards and Store Credit

ONYTCG offers digital Gift Cards and Store Credit that may be used on onytcg.com.

Gift Cards are delivered exclusively in digital format via email and do not involve the shipment of any physical product.

Gift Cards and Store Credit may be used to purchase available products and Pre-Orders unless otherwise specified on the product page.

Gift Cards and Store Credit may be used across one or more orders until the available balance has been fully exhausted.

Unless otherwise specified at the time of issuance, Gift Cards and Store Credit do not expire.

Any remaining balance remains available for future purchases.

Gift Cards and Store Credit cannot be redeemed for cash except where required by applicable law.

The remaining balance can be viewed by logging into your account and accessing the "My Credit" section.

12. Fraud Prevention Checks

To protect both customers and the seller, certain orders may be subject to manual verification.

The seller reserves the right to request confirmation of customer information or cancel suspicious orders.

13. Shipping and Delivery

Orders are primarily shipped using:

  • UPS

  • BRT

The seller may also use equivalent courier services.

Shipping costs and estimated delivery times are displayed during checkout.

Delivery times are indicative and may vary due to circumstances beyond the seller's control.

Customers are required to inspect the package upon delivery.

Any visible damage must be reported immediately to the courier and communicated to info@onytcg.it within 48 hours of delivery.

The risk of loss or damage to the products passes to the customer upon delivery.

14. Right of Withdrawal

Consumers residing within the European Economic Area have the right to withdraw from the purchase contract within 14 days of receiving the goods, without providing any reason.

For orders delivered in multiple shipments, the withdrawal period begins upon receipt of the final item.

To exercise the right of withdrawal, the customer must send an explicit communication within the withdrawal period to:

15. Return of Products

After notifying the withdrawal, the customer must return the products within 14 days.

Returned products must be:

  • intact;

  • complete with any accessories;

  • properly packaged;

  • not used beyond what is necessary to verify their nature and characteristics;

  • accompanied, where possible, by the order reference.

For sealed products (including Booster Boxes, Displays, Starter Decks, Bundles, and similar items), returns are accepted only if the products remain sealed and intact, except where opening was necessary to verify a conformity defect.

16. Exclusions from Withdrawal

The right of withdrawal may be excluded in cases provided by law, including:

  • customized or made-to-order products;

  • opened sealed products where excluded by applicable regulations;

  • products damaged by the customer;

  • incomplete products;

  • products used beyond normal inspection.

Consumer rights relating to conformity defects remain unaffected.

17. Return Shipping Costs

Return shipping costs are the responsibility of the customer, except in cases involving:

  • seller error;

  • incorrect product supplied;

  • defective or non-conforming products;

  • a different written agreement.

The use of a tracked shipping service is strongly recommended.

ONYTCG is not responsible for returns lost in transit when shipped without tracking.

18. Refunds

Once the returned products have been received and inspected, the refund will be processed within 14 days.

The seller may withhold the refund until the returned goods have been received or until proof of shipment has been provided by the customer, whichever occurs first.

Refunds will be issued using the same payment method used for the original purchase unless otherwise agreed.

As an alternative to a refund through the original payment method, the customer may voluntarily choose to receive ONYTCG Store Credit equal to the value of the refund due.

The Store Credit may be used for future purchases on onytcg.it and onytcg.com.

Acceptance of Store Credit is entirely optional and does not limit any statutory consumer rights.

Unless otherwise specified at the time of issuance, ONYTCG Store Credit does not have a predefined expiration date.

In the event of order or pre-order cancellations due to product unavailability, insufficient distributor allocations, or other circumstances beyond ONYTCG's control, the customer may choose between:

  • a refund via the original payment method;

  • ONYTCG Store Credit of equal value.

Refunds will include:

  • the price of the returned product;

  • the original standard shipping cost where required by applicable law.

Additional costs resulting from premium shipping, express shipping, or optional services selected by the customer will not be refunded.

19. Legal Warranty

Consumers are entitled to the legal warranty of conformity provided under applicable Italian and European legislation.

Where a conformity defect is reported within the applicable legal period, the customer may be entitled, where applicable, to:

  • repair;

  • replacement;

  • price reduction;

  • refund.

20. Limitation of Liability

The seller shall not be liable for:

  • delays caused by shipping carriers;

  • force majeure events;

  • temporary unavailability of the website or platform;

  • indirect damages or loss of profit not resulting from intentional misconduct or gross negligence.

Nothing in these Terms shall limit mandatory consumer rights.

21. Intellectual Property

All trademarks, logos, images, texts, and website content remain the property of their respective owners.

Unauthorized reproduction, distribution, or use is prohibited.

22. Privacy

Personal data is processed in accordance with the Privacy Policy published on the website and in compliance with the GDPR and applicable laws.

23. Governing Law and Disputes

These Terms and Conditions are governed by Italian law.

For disputes involving consumers, jurisdiction shall lie with the court of the consumer's place of residence or domicile, where required by applicable law.

Customers are encouraged to contact the seller at info@onytcg.it before initiating legal proceedings in order to seek an amicable resolution.
